Will I get sued if I use an undead Lichking, who has an army of various undead creatures, read zombies, vampires, ghouls, ghosts, and toxic slimes? I mean, ASOIF did it first.
Seems rather unlikely. Of course, you can get sued ... But whether it leads anywhere is another question.

Rule of thumb, if you don't copy the names, it needs to be extremely similar for any legal infractions; if there are differences, you can say it was an inspiration and no one will be able to prove you otherwise. That doesn't mean people won't have issues with it, because some probably will if the original is well-known, but the Lich with an undead army has been used so many times it's more like a trope now.

Heroes of Might & Magic did it even earlier
Master of magic did it earlier than heroes of might and magic.

I guess it doesn't explicitly say rjak is a lich but he hides his face and uses death magic.
