I've been writing a story with an MC who wakes up inside the body of a Duchess. There is no love between her and her husband at first because the marriage is political, but the husband notices the sudden change in her personality and becomes interested in her.
The husband asks MC to say her name during intercouse, and finds out she is a different person than his wife but with the same body. He decides to do nothing about this because he likes the MC better than his wife.
Does this count as NTR? The husband is cheating with someone who isn't his wife in spirit but physically she is still his wife.

From the man's perspective it would probably be, but from the reader's perspective it would all depend on the details and their interpretation. Though with only the description you gave I'd say it's not.
At least, if someone accuses you that it's NTR, you can give a very good reason why it's not.

No, It’s not. You said it yourself, there was no love between them, and it was only a political marriage. Then, with the sudden transmigration, the husband suddenly likes her, and I guess she likes him as well given that they have sexual intercourse and all. I don’t see this as NTR at all. Though, if you write from the original owner of the body’s perspective, thing might be slightly different, but since there was no love between the two, I don’t see this ever becoming an NTR.

No, because it's still the same person... the body at least. Okay, sure, let's pretend that this new personality makes her a new person. So what? Okay, let's imagine a married couple. One of them got into an accident that made him -or her- have a new personality. and his/her partner loves this new personality. Now, would you consider this cheating?
No. Of course not.
Even if there is no love before these changes. They are still the same mariage couple.

It qualifies as Netori I think, where the protag invites or "invites" the target to cheat and they forget about their previous partner. It's still NTR but it's a variant that's considered far less controversial. The usual wannabe chads who claim it rots your brain or makes you a "beta" won't care too much because it's not their projection fantasy being placed in an uncomfortable position because they're the "bull," not the "cuck". The thought of ruining someone else's potential true love relationship after effectively killing them might do something for a smaller crowd, just as it might put some people off ( If I told you I had a spell that would bind your body to the soul of a random dude from the 1400s so he/she could bang your SO as soon as you died, how many of you would choose to be cremated?).

It's only a no for the sake of the common audience, but that's enough.
