Does anyone know if a case where a writer was sent to court because of using a copyright images? Because I like using them but when a watpadd author said I could go to court I became scared.

Basically you can get sued if you are caught using copyrighted images.

Well, technically, it's illegal. You can be sued for it, and blah-blah, but some authors on SH monetize their fanfics, which is also illegal and violates the rules of the site, yet they don't even get their stories removed.

Technically, it's illegal. In reality most people don't care nearly enough to go as far as to the court. Make a note that if the author wants the image removed they should contact you and you'll take it down, and you shouldn't get into trouble. You might, if the artist and/or your story are well-known or if the artist is a really massive cunt, but most simply won't bother.

That is not to say I'm encouraging you to do that, but it's something of a very low-risk low-loss game.

Most if not all copyright holders will send you a Cease-and-desist first if they think you are violating copyrights. It never goes further unless you decide to keep using said image. Most companies really don't care if you use a copyrighted image though, since there are clauses of fair use that allow the use of copyrighted images with certain conditions. I know of cases where they did take it to court but is because the offenders used it for profit/political purposes. I don't think they will even bother with someone using a copyrighted image for a fanfic cover.

I'm not encouraging its use, is not right, but still, unless the copyright holder is a massive asshole is not going to get farther than a cease-and-desist letter.

It's basically never worth the effort like 99.99% of the time you can get away with it as neither parties have the resources to waste over it

And if it did happen most courts would probably just tell you to stop using it and MAYBE pay a small fine to the "injured" party

Also I'm not a lawyer I just like to watch lawyers on YouTube and rumble talk about these kinds of things

nah unless you have big money they wont give a shit. At most, they can threaten you with a lawsuit and make you change it.

You can have very high chance to get sent to court if your book cover is using copyrighted image and the book itself manage to become international bestseller for quite a long time.

Or if you're selling clothes/physical object that contains copyrighted imagery, and the author of the image has enough follower to gain awareness and support against the product, plus support of the online shop platform that the stealer use.

But if it's just your pathetic web novel cover, you may as well use it without shame since no one can actually care.

The worst scenario is a influential image creator didn't contact you and going straight to accuse you 'rightly' to make sure people boycott your stories and other works, and report it en-masse.

if your story is being published and promoted on Facebook, Twitter, Instagram, and other social medias, they can attack you using standar social media attacks.

But really, in practice, you can use copyrighted image until your story gain enough audience and money, and then pay some good designer on Fiverr/somewhere to make good image cover that resemble the old image or even better personalized cover.

make sure you don't criticize the designer too hard, if you don't really know how modern design actually works. You just need to convey how the novel is about, the general lines, the plot right now, the plot back then, and the plot in the future, how you want people to see it, and how you as the author see it. The design will be quite costly, and it will be even more expensive if the design has to contain several messages, but it's defined worth it if the story you write is that good and manage to gain audiences.

Yep, I also didn't believe in buying copyright of existing image. NFT sucks.

It's always better to use the money for professional services to design personalized book covers, anime style cover, and other paid services to make your needed image.

If you write seriously, then it is always a good idea to never use other people's artwork in your cover image. Learn some GIMP and get some free stock images and combine your own, it's actually not that hard. You get an OK result and with no risk of messy legal stuff.
But if you're just a casual hobbyist then it's what ever.
