You should be able to write it and be fine.

I interpret "illegal content" as things illegal to put in a book otherwise basically every book ever fails.

The other main line is "Don't encourage illegal sex acts" which you should be fine unless youre saying "Drunk Sex Is Awesome Go Do It Now!" or something.

And for the "may cause" clauses, you can't control other people, so for like 99.9% of purposes those may as well not exist

Legally speak, no. But in books, go wild, there may be an upper limit but nothing said about how wide you can make it.

Just remember, it is all fiction. The real problem starts when you do it irl.

If both parties are drunk, it comes down to who files charges first. And yes, men can file charges against women if they have sex with you while you are drunk. The thing is, it comes down to who files charges first, thus locking out the other person from filing charges.

As a layperson, I know from casually reading the news that in many judiciaries, US and otherwise, cases like this are successfully prosecuted every day.

While simultaneously, actual rape kits go untested.

There is the expression "bad cases" make bad law. And your scenario is waaaay underspecified.

For your purposes, specify {Did she consent?} {How impared was she?} {Was the other participant a predator?} {Does the legal establishment and society persecute women and the other participant, etc.}

Also, on a societal level, we don't want people raping drunk women.
true, but it is a gray zone how do u know consent when she is drunk, and what if u are drunk too its hard the best is just to not go after the girl if she is too drunk

Legal. She is of age so it's okay. if she was drunk though then it's not morally okay.

Scenario 1: She was unconscious at a party when a stranger penetrated her vaginally.

Scenario 2: She was unconscious at a party when a stranger penetrated her vaginally. For plot reasons, she enjoyed it.

Scenario 3: She got slightly drunk with her female crush, flirted, then blacked out - when she came to herself, they were having sex. The next day, marriage!

And we have absolutely no blasted idea what scenario OP is contemplating. Absolutely none.

It's like:"Oh hey, I'm too busy to give you details, but is it ethical to kill or eat the mammal in my living room? " "Should I take this pill from a medicine cabinet - it's a secret whether or not it's my medicine cabinet?" "I once found a piece of string. I was drunk. How long was the piece of string."
